SMS & TCPA Policy
Last reviewed: October 21, 2026 • Applies to every APEX account
Text messaging has become one of the fastest ways for insurance agents to reach clients, and the rules around it have tightened in step. Wireless carriers now screen business texts closely, and numbers that draw repeated spam flags gradually lose their ability to reach inboxes.
Anyone sending from an APEX account must comply with the Telephone Consumer Protection Act (TCPA) and with carrier messaging requirements. Before you send marketing texts, the recipient must have agreed to hear from you. You, not APEX, are the sender of every message from your account.
Practices that protect your deliverability
- Register before you send. Complete 10DLC brand and campaign registration using your business EIN. Unregistered traffic is increasingly filtered or rejected outright by U.S. carriers.
- Respect quiet hours. Schedule messages, including automated drips, so they go out only during daytime hours in the recipient’s local time zone, and always within any narrower window your state requires.
- Make consent and opt-out obvious. Your opening message to a number should explain why the person is hearing from you and tell them how to stop, for example “Reply STOP to opt out.”
- Say who you are. Name yourself and your agency in every message so the recipient never has to guess who is texting them.
- Pace large lists. After importing a big batch of leads, spread the outreach across days rather than sending to everyone at once. Sudden volume spikes are a common spam signal.
- Write like a person, not a promotion. Steer clear of phrasing carriers associate with spam, such as all-caps text, strings of exclamation marks, “FREE”, “act now” or “guaranteed”, and do not use public link shorteners.
- Keep it brief. Short, conversational messages are easier to read and less likely to be flagged than long blocks of text.
- Stop the moment you are asked. When someone opts out or asks to be added to your Do Not Call list, end all calls and texts to that person right away.
Accounts that keep breaking carrier rules see delivery rates fall and may have messaging throttled or suspended. This policy works together with our User Code of Conduct and Terms and Conditions.
We want every APEX agent to stay in touch with clients and prospects as smoothly as possible, and these habits go a long way toward that. Questions? Email [email protected].
